If the Buyer chooses not to inspect the machine, the Buyer accepts the machine in the "AS IS" condition. Expert Heavy Equipment Inc. makes no warranties with respect to the equipment, either expressed or implied, as to any matter whatsoever, including without limitation, it's safety, merchantability, or fitness for any particular purpose, or accuracy of manufacturer's printed material. This equipment has not been checked or verified for safety and is sold as is. The Buyer shall indemnify, hold harmless and defend Expert Heavy Equipment Inc from and against any and all losses, damages, liabilities and claims. Buyer is responsible for all attorney fees, costs and collections costs, legal fees and expenses arising from this sale. Buyer agrees that all actions or proceedings arising in connection with this sale shall be tried and litigated exclusively in the state and federal courts located in the county of Galveston, state of Texas. The Buyer is responsible for remitting sales tax unless a resale tax exempt certificate is supplied to the Expert Heavy Equipment Inc. By sending payment for the machine, the buyer accepts these terms and conditions.
